“La parte de los crímenes” plantea un reto inédito en cuanto al ejercicio de la narración de los feminicidios cometidos en México durante los años noventa del siglo pasado. Sobre ese fondo problemático, el presente artículo se despliega en dos partes. En la primera, siguiendo a Kant y a Lyotard, se propone mostrar la singularidad de la experiencia de lo sublime ocasionada por (el relato de) los crímenes. En la segunda, se abre la posibilidad de que una comprensión del hecho (...) en su conjunto pueda apelar a figuras de la razón, pero, en lugar de volver a Kant, lo resuelve apelando a algunos conceptos-idea de Giorgio Agamben que han venido a enriquecer el paisaje de la filosofía política contemporánea. Hasta ahora, las discusiones sobre el multiculturalismo se han presentado como una revisión progresista de los límites del liberalismo en cuanto a políticas de inclusión y reconocimiento. Este artículo plantea que la recepción del multiculturalismo en Latinoamérica, si no quiere ser puramente procedimental, puede plantearse como una deconstrucción de los conceptos de Sujeto y Estado. Para ello hemos adoptado el punto de vista de comunidades étnicamente diferenciadas (que Deleuze y Guattari han categorizado como máquinas territoriales), de modo que sus relaciones (...) de poder y sus procesos de subjetivación puedan ser vistos como expresión de lo intraestatal y lo preindividual, respectivamente. Aunque esta diferencia de perspectiva se plantea, básicamente, como un diferendo entre teorías, al final se sugieren criterios para un debate más amplio sobre las relaciones entre Estado y capitalismo alrededor de las condiciones de existencia de las sociedades premodernas. RESUMEN En este artículo propongo revisar las aproximaciones de Mabel Moraña y Antonio Cornejo Polar al clivaje paradigmático entre las figuras de José María Arguedas y Mario Vargas Llosa en la cultura latinoamericana. En ese marco, tanto Cornejo Polar como Mabel Moraña desarrollan, en su propio lenguaje, preguntas por los dispositivos de poder y por las estrategias de resistencia que derivan de las relaciones entre literatura y máquinas sociales planteadas por Deleuze y Guattari, en una perspectiva decolonial. Este será el (...) contenido de la primera parte. En la segunda, quisiera seguir el derrotero de Cornejo Polar en la creación del concepto de 'subjetividad heterogénea', que condensa la experiencia de la migración interna en los países andinos y está presente con especial intensidad lingüística y performativa en El zorro de arriba y el zorro de abajo, la última obra de Arguedas. ABSTRACT This article intends to review the approaches of Mabel Moraña and Antonio Cornejo Polar to the paradigmatic cleavage between the figures of José María Arguedas and Mario Vargas Llosa in Latin American culture. Within this framework, both Cornejo Polar and Mabel Moraña develop, in their own language, questions about power devices and resistance strategies derived from relationships between literature and social machines raised by Deleuze and Guattari, from a decolonial perspective. This will be the content of the first part. In the second, it would like to follow Cornejo Polar's path in creating the concept of 'heterogeneous subjectivity', which condenses the experience of internal migration in the Andean countries and is present with particular linguistic and performance intensity in El zorro de arriba y el zorro de abajo, the last work of Arguedas. Este ensayo se plantea las relaciones entre dos regímenes de visibilidad: pintura y televisión, que parecen constitutivos de la tradición cultural en Occidente. El propósito es analizar esa relación siguiendo tres estrategias: la primera, traza la genealogía que va del cuadro como modo privilegiado de representación visual a la pantalla como medio privilegiado de simulación; la segunda, rastrea los diferendos y las hibridaciones entre arte y televisión, contrastando el “déficit de realidad” que caracteriza al arte en relación con el exceso (...) de copias, reproducciones y simulaciones de “lo real” que caracteriza la televisión; por último, se sugieren formas de resistencia a las políticas de producción masiva de imágenes televisivas en el mundo actual. This article explores the sources of the concept of difference advanced by Deleuze and, in particular, the idea of a non-phenomenological difference, understood as internal difference. In the first part, Deleuze’s appropriation of the concepts of memory and duration proposed by Bergson is explored, as if it corresponded with a response to Heidegger’s systematization of Nietzsche, thus opening the concept of forces to others such as heterogeneity, relativity, and multiplicity. The second part contains a dicussion of the hypothesis according to (...) which the immersion in the Bergsonian synthesis of time results in the justification for the reformulation of the eternal return as repetition, the distinctively deleuzian problem of internal difference, and the concept of virtual as the definitive sign of a new plane of immanence for thought. The article concludes by presenting the internal difference from the outside that overflows it and makes it mutate in the whole of Deleuzian philosophy. (shrink)

El artículo aborda la relación filosofía/literatura teniendo plan en el contexto de la moderna novela latinoamericana. En la primera parte se retoman las discusiones sobre el indigenismo para examinar hasta donde la crítica y el olvido del que fue objeto son justificados. La pregunta, en este caso, es si se trata de un problema filosófico relativo a la representación y, si es el caso, cómo escapa la novela a la filosofía de la representación “indigenista” para hacerse plenamente moderna. La segunda (...) parte describe la influencia del surrealismo en la novela americana, para mostrar cómo la pregunta por lo moderno es una pregunta por el presente que O. Paz logró formular desde muy pronto en sus ensayos teórico-poéticos. La tercera parte plantea la pregunta por los mundos literarios y su relación indisociable con el yo, el punto de vista y el ensamblaje desbordante del concepto de máquina literaria a la imagen del sujeto-escritor. This paper argues that “free will” is vague. The argument has two steps. First, I argue that free will is a matter of degrees and, second, that there are no sharp boundaries separating free decisions and actions and non‐free ones. After presenting the argument, I focus on one significant consequence of the thesis, although others are mentioned along the way. In short, considerations of vagueness help understand the logic behind so‐called manipulation arguments, but also show why these arguments are ultimately (...) flawed. (shrink)

This book explores the relevance of virtue theory to law from a variety of perspectives. The concept of virtue is central in both contemporary ethics and epistemology. In contrast, in law, there has not been a comparable trend toward explaining normativity on the model of virtue theory. In the last few years, however, there has been an increasing interest in virtue theory among legal scholars. 'Virtue jurisprudence' has emerged as a serious candidate for a theory of law and adjudication. Advocates (...) of virtue jurisprudence put primary emphasis on aretaic concepts rather than on duties or consequences. Aretaic concepts are, on this view, crucial for explaining law and adjudication. This book is a collection of essays examining the role of virtue in general jurisprudence as well as in specific areas of the law. Part I puts together a number of papers discussing various philosophical aspects of an approach to law and adjudication based on the virtues. Part II discusses the relationship between law, virtue and character development, with some of the essays selected analysing this relationship by combining both eastern perspectives on virtue and character with western approaches. Parts III and IV examine problems of substantive areas of law, more specifically, criminal law and evidence law, from within a virtue-based framework. The purpose of this paper is to compare disagreement in two different WhatsApp groups: one for members of the same family, and another for work colleagues. After the analysis, 427 instances of disagreement were identified in the family group, and 161 in the interactions between work colleagues. The most common strategy in both corpora is ‘Giving opposite opinions’. Nevertheless, the rest of the results present very significant dissimilarities, most notably the higher presence of disagreement in the family WhatsApp group. This (...) higher tolerance for disagreement is corroborated by the choice of linguistic strategies made. Whereas the family members tended to give emotional or personal reasons for disagreement, as well as negative comments on the topic, the colleagues preferred to express their disagreement with mitigating expressions and token agreement. Thus, in the corpora studied, the expression of disagreement seems to be less face threatening for family members than for work colleagues. (shrink)

This paper defends a version of the Simple View, the claim that someone intentionally φs only if the person intends to φ. To do this, I raise a problem for Bratman’s classic argument (1984, 1987) against it. The problem brings into focus an evaluative dimension behind the View, whose recognition allows for an improved version of it. With this improved version, I then go on to answer other criticisms that have been raised to it.

This paper argues that habits, just like beliefs, can guide intentional action. To do this, a variety of real-life cases where a person acts habitually but contrary to her beliefs are discussed. The cases serve as dissociations showing that intentional agency is possible without doxastic guidance. The upshot is a model for thinking about the rationality of habitual action and the rationalizing role that habits can play in it. El presente artículo pretende destacar que las respuestas afectivas de los seres humanos ante la realidad son constitutivas de los juicios morales desde dos perspectivas: a) un ordo amoris objetivo con funciones normativas; b) un ordo amoris descriptivo que explica las variaciones en los juicios morales. El problema filosófico consiste en que la descripción de la afectividad suele ser abordada por ciencias empíricas y es parte de la casuística. Pero, desde la perspectiva fenomenológica de Max Scheler se hace posible su (...) abordaje filosófico, sin caer en la casuística. De modo análogo, a lo que sucede en la lógica y su tratamiento de las falacias, la axiología fenomenológica puede describir la afectividad en busca de aquellos elementos que distorsionan el juicio moral. This article aims to emphasize that affective responses of human beings to reality are constitutive of moral judgments from two perspectives: a) an objective ordo amoris with normative functions; b) a descriptive ordo amoris, which explains the variety of moral judgments. The philosophical problem consists in the fact that description of affectivity is usually examined by empirical sciences and is part of casuistry. But from the point of view of Max Scheler’s phenomenology it is possible to study this issue without the tendency to casuistry. In a similar way to logic and its dealing with fallacies, phenomenological axiology is able describe emotions seeking those elements that distort moral judgment. (shrink)

:In this essay, I present an account of forgiveness as a process of emotional distancing. The central claim is that, understood in these terms, forgiveness does not require a change in judgment. Rationally forgiving someone, in other words, does not require that one judges the significance of the wrongdoing differently or that one comes to the conclusion that the attitudes behind it have changed in a favorable way. The model shows in what sense forgiving is inherently social, shows why we (...) should be pluralists about it, and provides a basis for arguing against the existence of necessary conditions of forgiving. The aim of this essay is to develop a coherence theory for the justification of evidentiary judgments in law. The main claim of the coherence theory proposed in this article is that a belief about the events being litigated is justified if and only if it is a belief that an epistemically responsible fact finder might hold by virtue of its coherence in like circumstances. The article argues that this coherentist approach to evidence and legal proof has the resources to (...) meet some of the main objections that may be addressed against attempts to analyze the justification of evidentiary judgments in law in coherentist terms. It concludes by exploring some implications of the proposed version of legal coherentism for a jurisprudence of evidence. (shrink)

Desde el momento en que se consumó la independencia de Colombia, y como efecto del legado militar que se heredó de la guerra, se generó una intensa discusión sobre los asuntos militares, y especialmente sobre el lugar y el papel que los uniformados debían ocupar y desempeñar en el marco del nuevo orden institucional. El desarrollo de ese debate no solo aparejó dicha discusión, sino que desembocó en la configuración de un ingenioso y persuasivo discurso civilista, en virtud del cual (...) se intentó subordinar a los uniformados y cimentar el orden institucional de la república. Describir el contenido y alcance político de esos discursos y debates, a partir de lo que se publicó en algunos periódicos y documentos de la época; y dilucidar cómo influenciaron el curso de la vida política e institucional colombiana durante aquellos años, son los objetivos del presente artículo. La obra de Homero permite adentrarnos en los ideales y fundamentos de la cultura griega, uno de los ámbitos lo constituye el legado respecto a la conformación de lo político en Occidente. En La Odisea se hace palpable la hospitalidad en tanto vínculo que se establece entre comunidades. Más allá de la simple acogida y ayuda que se presta a un huésped, se trata del reconocimiento del otro, por ende, de las tensiones de la comunidad y la amplitud de sus (...) límites. A lo largo del viaje de retorno de Odiseo a Ítaca, se exponen los presentes hospitalarios entregados desde el espacio doméstico, en el cual las figuras femeninas adquieren una particular relevancia en la donación de la hospitalidad, como en su propia posibilidad. En este trabajo se identifica y analiza la centralidad de los personajes femeninos en el adecuado desenvolvimiento de lo hospitalario como vector civilizatorio. (shrink)

This paper articulates an egalitarian conception of judicial humility and justifies its value on the grounds that it importantly advances the legal and political ideal of fraternity. This account of the content and value of the virtue of humility stands in sharp contrast with the dominant view of judicial humility as deference or judicial restraint. The paper concludes by discussing some ways in which the account of humility and of its value provided in the paper furthers our understanding of the (...) judicial virtues and of the political implications of giving virtue a role in adjudication. Philosophical accounts of moral responsibility are standardly framed by two platitudes. According to them, blame requires the presence of a moral defect in the agent and the absence of excuses. In this chapter, this kind of approach is challenged. It is argued that (a) people sometimes violate moral norms due to performance mistakes, (b) it often appears reasonable to hold them responsible for it, and (c) their mistakes cannot be traced to their moral qualities or to the presence of excuses. The university that Alasdair MacIntyre defines as liberal is that which rejects the tradition as something pre-modern and with an impediment for the progress, including the pedagogic one. This university model has been extended in all instances, giving priority to the technical education in a pragmatic way. Thus, the global and sapiential vision of the university has been relegated. This last approach is the key for unifying the knowledge and to pass it onto other people and, therefore, to educate and (...) mold intellectually and morally. However, the professionalization of the philosophy and the criteria of the modern liberalism seem to dominate and inspire most universities in the present day. This situation has plainly shown an inability to become aware of their incompetence to properly educate professors and students alike, in a sapiential and moral manner, threfore deceiving themselves with a naive rhetoric. Alasdair MacIntyre: narrative introduction to his work In the wake of the publication of the last book of the British philosopher Alasdair MacIntyre, Ethics in the Conflicts of Modernity: An Essay on Desire, Practical Reasoning, and Narrative, this work proposes a way to understand his bibliographical production in the context of the narrative of his life and his intellectual career. It is elaborated a periodization of the itinerary of MacIntyre, based on the references that the author himself has made of (...) his academic life and in the proposals of several scholars of his thought. It is concluded that the narrative examination of MacIntyre’s work reveals that his philosophical project is basically marked by Aristotle and Aquinas, whose thought helped our author a solid proposal on the main issues of moral philosophy and philosophy of religion. This work is conceived as introductory because it focuses only on MacIntyre’s books, but it’s expected to serve as a solid basis for a thorough critical study —especially from a chronological perspective— of his entire work, which includes chapters of books, papers, interviews, among others. This paper argues that formal models of coherence are useful for constructing a legal epistemology. Two main formal approaches to coherence are examined: coherence-based models of belief revision and the theory of coherence as constraint satisfaction. It is shown that these approaches shed light on central aspects of a coherentist legal epistemology, such as the concept of coherence, the dynamics of coherentist justification in law, and the mechanisms whereby coherence may be built in the course of legal decision-making.

The functions and expression pattern of urea cycle enzymes have undergone considerable changes during the course of evolution. Sequence analyses shows that urea cycle enzymes from mammals are homologous to microbial enzymes of the arginine‐metabolic pathway. Recently, an unexpected relationship was found between argininosuccinate lyase (EC 4.3.2.1), the fourth enzyme of the cycle, and δ‐crystallin, a lens structural protein of birds and reptiles.

In this review, I discuss recent advances in philosophical and psychological approaches to self-control. The review is divided in 4 parts, in which I discuss: a) different conceptions of self-control; b) standard methods for studying it; c) some models of how self-control is exercised; and d) the connections between self-control and other relevant psychological constructs. The review was originally commissioned by the John Templeton Foundation to provide an informative overview that would knit together different strands of current debates in the (...) field. This paper examines the concept of coherence and its role in legal reasoning. First, it identifies some problem areas confronting coherence theories of legal reasoning about both disputed questions of fact and disputed questions of law. Second, with a view to solving these problems, it proposes a coherence model of legal reasoning. The main tenet of this coherence model is that a belief about the law and the facts under dispute is justified if it is “optimally coherent,” that is, if (...) it is such that an epistemically responsible legal decision-maker would have accepted it as justified by virtue of its coherence in like circumstances. Last, looking beyond the coherence theory, the paper explores the implications of the version of legal coherentism proposed for a general theory of legal reasoning and rationality. (shrink)

Dynamic Theodicy (DT) is a broad concept we bring up to designate some modern Philosophical Theology attempts to reconcile the necessary and perfect existence of God with the contingent characteristics of human life. In this paper we analyze such approaches and discuss how they have become incomprehensible because the metaphysical assumptions implicit in these explanations have lost their intrinsic relation to the natural human desire for salvation. In the first part we show Charles Hartshorne's DT-model, arising from the modal logic (...) of perfection, and the modern rational problems of this position in making infinite-necessary Being (God) and finite-contingent being (human) compatible. We note that at the heart of the contradictions in this DT account is a dialectical mode of thinking that makes it difficult to find a correct solution to this dichotomy, and to assume a human desire that could be considered related to lifelong goals. In the second part, supported by the proposal of Hans Urs von Balthasar's DT, we develop the concepts of bodily vulnerability, corporeal intentionality, and natural desire for salvation, which come from an Aristotelian-Thomistic thought. This theory is established in order to build an argument, following Alasdair MacIntyre’s ethical framework, on how to make possible the recovery of a metaphysical and anthropological desire that transcends natural aging and goes beyond death. We conclude that both human dependence and the virtues that arise naturally when human beings decide to seek the good of their transcendent condition, make it possible to recover the natural desire for salvation through divine and human love. In recent years coherence theories of law and adjudication have been extremely influential in legal scholarship. These theories significantly advance the case for coherentism in law. Nonetheless, there remain a number of problems in the coherence theory in law. This ambitious new work makes the first concerted attempt to develop a coherence-based theory of legal reasoning, and in so doing addresses, or at least mitigates these problems. The book is organized in three parts. The first part provides a critical analysis (...) of the main coherentist approaches to both normative and factual reasoning in law. The second part investigates the coherence theory in a number of fields that are relevant to law: coherence theories of epistemic justification, coherentist approaches to belief revision and theory-choice in science, coherence theories of practical and moral reasoning and coherence-based approaches to discourse interpretation. Taking this interdisciplinary analysis as a starting point, the third part develops a coherence-based model of legal reasoning. While this model builds upon the standard theory of legal reasoning, it also leads to rethinking some of the basic assumptions that characterize this theory, and suggests some lines along which it may be further developed. Thus, ultimately, the book not only improves upon the current state of coherence theory in law, but also contributes to the larger debate about how to articulate a theory of legal reasoning that results in better decision-making. En el presente trabajo se esclarece la noción de “información” según Gilbert Simondon, para lo cual se presenta el contexto histórico-epistemológico desde el cual surge y qué soluciones ofrece a la problemática de la época. Se hace especial énfasis en las conceptualizaciones realizadas por la teoría matemática de la información, la cibernética, y la biología. Luego, se analiza el devenir conceptual de la noción de “información” en el pensamiento de Simondon siguiendo tres momentos de su trabajo académico (clasificados por Juan (...) Manuel Heredia): a) 1944-1958, b) 1959-1968; y c) 1968-1983. Con ello, genero una idea más completa sobre su sentido. (shrink)

Most human actions are complex, but some of them are basic. Which are these? In this paper, I address this question by invoking slips, a common kind of mistake. The proposal is this: an action is basic if and only if it is not possible to slip in performing it. The argument discusses some well-established results from the psychology of language production in the context of a philosophical theory of action. Este artículo tiene el objetivo de dilucidar el contexto, contenido y propósito general de las críticas que Agnes Heller (1929-2019) planteó sobre las filosofías de la historia. Para tal efecto, se revisan algunos de los postulados de estas con el fin de destacar cómo Heller, a propósito del contexto político en el que vivió, volvió su mirada hacia esas filosofías con el fin de escrutar los vínculos que, a su parecer, se tejían entre ellas y los regímenes totalitarios que se (...) forjaron durante el siglo xx. Al respecto, se argumenta que las reflexiones de la autora no se orientaron solamente a dar cuenta de dicha cuestión, sino que, como resultado de su esmerada labor intelectual, de sus convicciones morales y de su propia experiencia personal, encaminó sus esfuerzos hacia la elaboración de una sugerente concepción de la historia que se fundamentó en criterios y principios éticos.
